These Terms of Use (“Terms”) govern access to and use of The Power of 90 Members, operated by FlyAway Productions (“The Power of 90,” “we,” “our,” or “us”).
By creating an account, purchasing a plan, beginning a free trial, providing parental consent, or allowing a child to use the program, you agree to these Terms and our Privacy Policy.
Adult Account Holder
A parent or legal guardian must create and manage the family account.
The adult account holder:
Must provide accurate account and payment information
Is responsible for protecting login credentials and child PINs
Authorizes each child’s participation
Is responsible for supervising the child’s use
Must provide the required parental consent
Is responsible for billing, cancellation, and account requests
Children may not independently create or purchase a paid family account.
Program Description
The Power of 90 is a 90-day guided journaling and personal-growth program that may include online or paper journaling, daily prompts, conversations with Bartholomew, optional voice playback, Achievement Points, rewards, and parent progress features.
Available features depend on the plan selected and may change as the program is maintained and improved.
Account Use
Accounts are intended only for the registered family and authorized children.
You agree not to:
Share account access outside the family
Attempt unauthorized access
Circumvent payment, safety, or security controls
Interfere with the website or its systems
Upload malicious technical content
Copy or distribute member-only materials
Use the program for unlawful purposes
You are responsible for activity occurring through your account unless you promptly notify us of unauthorized access.
Billing and Payments
Prices, plan duration, included features, trial terms, taxes, and recurring charges are displayed during signup or checkout.
By submitting payment information, you authorize our payment provider to charge the disclosed amount according to the selected plan.
You are responsible for maintaining valid payment information.
Seven-Day Free Trial
When a seven-day free trial is offered, the signup or checkout page will disclose:
The plan selected
The amount charged when the trial ends
Whether recurring payments apply
How to cancel before being charged
We will send a reminder email on the sixth day of the trial.
To avoid being charged, the adult account holder must cancel before the seven-day trial ends. Failure to see or open the reminder email does not extend the trial or prevent the disclosed charge.
Trial eligibility is limited to one trial per family unless otherwise stated.
Automatic Renewal and Failed Payments
If a plan renews automatically, the renewal frequency and amount will be disclosed before purchase.
By selecting an automatically renewing plan, you authorize recurring charges until cancellation.
If a payment fails, we may notify the adult account holder, retry the payment, provide a temporary grace period, or suspend access until payment is completed.
Cancellation
The adult account holder may cancel through the account controls or by contacting contact@thepowerof90members.com.
Cancellation during the free trial prevents the first paid charge when completed before the trial ends.
Cancellation after payment:
Stops future renewal charges, if applicable
Does not provide a refund
Allows access through the applicable paid program period unless the account is deleted or access is terminated for misuse
Cancellation does not automatically delete the family account or stored information. Account deletion must be requested separately.
No-Refund Policy
All payments are final and nonrefundable once charged, except when a refund is required by applicable law.
Failure to cancel before the free trial expires does not qualify for a refund.
Deleting an account, withdrawing parental consent, discontinuing use, or canceling after a charge does not create a right to a full or partial refund.
Account Deletion
Cancellation and deletion are different actions:
Cancellation stops future renewal charges and allows access through the applicable paid period.
Deletion closes the account, may immediately end parent and child access, and initiates deletion as described in the Privacy Policy.
If a parent wants access to continue through the paid period, the parent should cancel rather than delete the account.
Journaling and Rewards
For online journaling, the child must enter at least one word to record participation and receive applicable Achievement Points or rewards.
Children may instead write privately in a paper journal. Paper journal content is not collected by The Power of 90. The child clicks Done online to record completion and receive applicable Achievement Points or rewards.
Achievement Points and rewards have no cash value and cannot be transferred or sold.
Bartholomew and Safety Screening
Bartholomew uses artificial intelligence to provide general journaling guidance and encouragement. Bartholomew is not a person, therapist, counselor, doctor, or emergency professional and may misunderstand a message or provide an incomplete or inaccurate response.
Messages sent to Bartholomew are automatically screened for potential safety concerns. When a serious concern is detected, the system may:
Stop Bartholomew’s normal response
Display a fixed safety message
Make Bartholomew unavailable for the remainder of the child’s local day
Send the parent an email and Parent Dashboard alert containing a general safety category
The child’s journal remains available during the Bartholomew lockout.
Safety screening is a precaution only. We do not guarantee that every safety concern will be detected. Parents remain responsible for supervision, safety, and obtaining appropriate professional or emergency assistance.

Not a Medical or Emergency Service
The Power of 90 provides guided journaling, educational content, personal reflection, and general encouragement.
It is not medical or psychological treatment, therapy, counseling, crisis intervention, emergency monitoring, or a substitute for direct parental supervision.
The program is not continuously monitored by a person.
If a parent believes a child may be in immediate danger, the parent should contact emergency services or an appropriate crisis resource immediately.
Privacy
Our Privacy Policy explains what information is collected, how it is used, how service providers process it, how journal entries are stored, and how parents may review or delete information.
The Privacy Policy is incorporated into these Terms.
Ownership
The website, program structure, prompts, stories, videos, recordings, artwork, characters, Bartholomew content, logos, and other materials are owned by or licensed to FlyAway Productions.
Purchasing a plan provides a limited, personal, nonexclusive, nontransferable right to use the program for the registered family.
You may not copy, reproduce, resell, redistribute, publish, modify, or commercially use program materials without written permission.
The family retains ownership of its original journal entries.
Suspension or Termination
We may restrict, suspend, or terminate access when reasonably necessary to:
Protect children or families
Address security threats or misuse
Respond to failed payments
Enforce these Terms
Comply with legal requirements
When practical, we will notify the adult account holder of the reason.
Service Availability
We work to keep the program available and functional but do not guarantee uninterrupted or error-free access.
The program relies on third-party providers for hosting, payments, email, artificial intelligence, safety screening, and voice services. Third-party interruptions may temporarily affect availability.
We may perform maintenance, correct errors, update features, replace providers, or temporarily suspend functions for safety or security reasons.
Disclaimer of Warranties
To the extent permitted by law, the program is provided on an “as is” and “as available” basis.
We do not guarantee:
Specific personal, educational, emotional, or behavioral results
Continuous or error-free access
That every safety concern will be detected
That artificial-intelligence responses will always be accurate or appropriate
Nothing in these Terms excludes rights that cannot legally be excluded.
Limitation of Liability
To the extent permitted by law, FlyAway Productions and The Power of 90 will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use the program.
To the extent permitted by law, our total liability for a claim relating to the program will not exceed the amount paid for the affected plan during the preceding twelve months.
These limitations do not apply where prohibited by law.
Changes to These Terms
We may update these Terms when the program, laws, service providers, or business practices change.
The updated Terms will display a new “Last Updated” date. When required, we will provide notice and obtain renewed agreement or parental consent.
Governing Law
These Terms are governed by the laws of the State of Montana and applicable federal law, without regard to conflict-of-law principles.
